Thursday, November 12, 2026 (12:00 PM - 1:00 PM) (PST)

Description

With the diminishment of jury trials, trial consultants can offer insight into how jurors may interpret the evidence and law in a case. This perspective can help counsel assess and effectively present their cases’ strengths, address potential weaknesses, and make informed, merits-based decisions about whether to settle or proceed to trial, even when facing pressure from judges or mediators to settle. Trial consultants participate in dozens of mock and actual trials every year and can offer keen insights into jury psychology and communication preferences. While many attorneys have participated in a mock trial or worked with a trial consultant in jury selection, there are numerous other services that consultants can offer to assist counsel better prepare and position their case for either settlement of trial. In this talk, Richard Gabriel, President of Decision Analysis and one of the leading consultants in the country will discuss the following, among other issues: • On smaller cases, using a consultant to identify potential jury biases, confusion, or themes • How to best prepare and use jury research, such as focus groups, mock trials, or surveys • Helping witnesses to communicate more effectively in deposition and trial • How consultants prepare jury questionnaires, voir dire questions, and jury selection strategies • Using consultants for attorney presentation skill coaching
